WILLS, TRUSTS & PROBATE

Do I really need a will?

Yes. Having a will is essential for everyone over the age of eighteen. A will allows you to designate guardians for your children, specify how your assets should be distributed, and ensure your wishes are honored. Without a will, Florida law determines how your estate is divided.

What is the difference between a will and a trust?

A will is a legal document that outlines how your assets should be distributed after your death and goes through the probate process. A trust, on the other hand, allows you to transfer assets to beneficiaries while avoiding probate, often providing more privacy and flexibility. We can help you determine which option is best for your situation.

What is probate and how long does it take?

Probate is the legal process of administering a deceased person’s estate, including validating the will, paying debts, and distributing assets to beneficiaries. In Florida, probate can take anywhere from a few months to over a year, depending on the complexity of the estate. We guide families through every step of this process.

Can I avoid probate?

Yes, there are several strategies to avoid probate, including establishing a revocable living trust, designating beneficiaries on accounts, and holding property jointly. We can help you create an estate plan that minimizes or eliminates the need for probate.
